Welcome to Heart & Crunch. These Terms of Service ("Terms") govern your use of our website and your purchase of products from us. By placing an order or using our site, you agree to be bound by these Terms. Please read them carefully.

Heart & Crunch ("we", "us", "our") sells dried fruits, nuts and seeds online, with delivery across South Africa.

2. Products

We make every effort to accurately describe our products, including pack sizes, ingredients, and nutritional information. However:

Product images are for illustrative purposes and may vary slightly from the item received (e.g. natural variation in colour, size or shape of dried fruit and nuts).
Nutritional and energy values listed are typical reference figures for the product type and may vary by batch. For lab-verified figures for a specific batch, please contact us.
Availability of products and pack sizes is subject to stock on hand at the time of ordering.

3. Allergen Notice

Our products are prepared and packed in a facility that also handles nuts, peanuts, tree nuts, sesame, and other allergens. Even where a specific product does not contain a listed allergen as an ingredient, cross-contamination may occur. If you have a food allergy or intolerance, please contact us before ordering, and always check product packaging on arrival. We are not liable for allergic reactions arising from failure to heed this notice.

4. Ordering Process

Orders are placed as follows:

You browse our catalog and select your products and pack sizes.
Select products you need on our website (www.heartandcrunch.myshopify.co.za)
Payment is made securely via Yoco using the payment link provided on your invoice.
Once payment reflects, we prepare and dispatch your order.

An order is only confirmed once payment has been received in full. We reserve the right to decline or cancel any order, including where stock is unavailable, pricing errors have occurred, or fraudulent activity is suspected — in which case any payment made will be refunded.

5. Pricing & Payment

All prices are listed in South African Rand (ZAR) and are inclusive of applicable taxes unless stated otherwise.
Prices are subject to change without notice, but the price confirmed on your invoice at the time of order will be honoured.
Payment is processed via Yoco. We do not store your card or payment details.

6. Delivery

Delivery fees are calculated by area and added to your invoice before payment: 100 standart, and R150 elsewhere in South Africa.
Estimated delivery timeframes are provided at the time of order confirmation but are not guaranteed. We are not liable for delays caused by third-party couriers or circumstances outside our control.
Risk in the products passes to you upon delivery to the address provided.
It is your responsibility to provide an accurate delivery address and to be available (or arrange for someone to be available) to receive the order.

7. Returns & Refunds

Due to the perishable and consumable nature of our products, we do not accept returns once an order has been received, except where the item is damaged, incorrect, or defective due to our error. Refunds also apply where an order has not yet been shipped or where we are unable to fulfil an order due to stock unavailability. Full details are set out in our separate [Return & Refund Policy].

8. Storage & Use

Storage recommendations are provided on individual product listings. We are not responsible for product quality issues arising from incorrect storage after delivery (e.g. exposure to heat, moisture, or failure to reseal packaging).

9. Limitation of Liability

To the fullest extent permitted by law, Heart & Crunch shall not be liable for any indirect, incidental, or consequential loss or damage arising from the use of our products or website, except where such liability cannot be excluded under the Consumer Protection Act 68 of 2008. Nothing in these Terms limits any right you may have under South African consumer protection law.

10. Intellectual Property

All content on our website and marketing materials, including logos, product descriptions, and images, is owned by or licensed to Heart & Crunch and may not be copied, reproduced, or used without our prior written consent.

11. Acceptable Use

You agree not to use our website or ordering channels for any unlawful purpose, to submit fraudulent orders, or to interfere with the operation of our site or services.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised "Last updated" date. Continued use of our site or services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of our services will be subject to the jurisdiction of the South African courts.
